NurseLift365 is operated by Balanced Wellness LLC (“NurseLift365,” “we,” “us,” or “our”).

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, do not use the Service.

You must be at least 13 years old to use NurseLift365.

If you are under the age of 18, you may use the Service only with the permission and supervision of a parent or legal guardian.

Certain features may have additional age or eligibility requirements.

By using the Service, you represent that:

• You meet the applicable age requirements;
• You have authority to enter into these Terms;
• The information you provide is accurate and current; and
• You will use the Service in compliance with applicable laws.

NurseLift365 is a wellness, encouragement, and motivational platform designed primarily for nurses, nursing students, healthcare professionals, and other healthcare workers.

The Service may include:

• Motivational messages and quotes;
• Encouragement and wellness content;
• Educational or informational content;
• Personalized content based on user-selected preferences;
• Push notifications;
• User profiles;
• Community or interactive features;
• Premium subscription features;
• Advertisements;
• Customer support;
• Email communications;
• Social sharing features; and
• Other features that may be added or modified over time.

Features may differ between free and Premium users.

NurseLift365 is intended for general encouragement, wellness, informational, and motivational purposes only.

NurseLift365 is not a healthcare provider and does not provide medical, psychiatric, psychological, therapeutic, nursing, legal, financial, or other professional advice.

Information provided through the Service should not be relied upon as a substitute for consultation with a qualified healthcare professional.

If you are experiencing a medical or mental health emergency, contact emergency services or an appropriate qualified professional immediately.

Do not use NurseLift365 to diagnose, treat, prevent, or manage a medical condition.

NurseLift365 is not an emergency response service.

The Service should never be used to report an emergency, request immediate medical assistance, or communicate urgent patient-care information.

Call 911 or contact the appropriate emergency service when immediate assistance is required.

Certain features may require you to create an account.

You agree to provide accurate, complete, and current information.

You are responsible for:

• Maintaining the confidentiality of your login credentials;
• All activity occurring under your account;
• Updating inaccurate account information; and
• Notifying us promptly if you believe your account has been compromised.

You may not use another person’s account without authorization.

We reserve the right to suspend or terminate accounts that violate these Terms.

NurseLift365 is not intended to collect, store, transmit, or process protected health information (“PHI”) or confidential patient information.

You agree not to upload, post, transmit, or otherwise provide:

• Patient names;
• Medical records;
• Patient photographs;
• Patient identification numbers;
• Addresses;
• Phone numbers;
• Medical histories;
• Insurance information;
• Protected health information;
• Confidential employer information; or
• Other information that identifies or could reasonably identify a patient.

Do not use NurseLift365 as a patient-care documentation or communication system.

If you accidentally submit confidential or patient information, contact us promptly so we can determine appropriate steps.

You may be able to submit information, comments, feedback, profile information, posts, messages, images, or other content (“User Content”).

You retain ownership of User Content that you submit.

However, by submitting User Content, you grant NurseLift365 a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, display, and use that content as reasonably necessary to operate, maintain, improve, and provide the Service.

You represent that you have the right to submit the content and that your content does not violate any law or third-party rights.

You must not submit content that:

• Is illegal;
• Is threatening or abusive;
• Harasses another person;
• Contains private or confidential information;
• Contains patient information;
• Infringes intellectual property rights;
• Contains malicious code;
• Promotes harmful activity; or
• Violates these Terms.

We may remove User Content that violates these Terms or that we reasonably believe creates risk to users or the Service.

Users must interact respectfully.

You agree not to:

• Harass, threaten, intimidate, or abuse others;
• Impersonate another person;
• Attempt to obtain another user’s credentials;
• Spam users;
• Distribute malware;
• Attempt unauthorized access to the Service;
• Scrape or harvest user information;
• Interfere with the operation of the Service;
• Reverse engineer the Service except where legally permitted;
• Use automated systems to access the Service without authorization;
• Use the Service for unlawful purposes; or
• Attempt to circumvent security or subscription restrictions.

The NurseLift365 name, logo, trademarks, branding, software, design, graphics, original content, text, videos, audio, features, and other materials provided by NurseLift365 are owned by or licensed to Balanced Wellness LLC unless otherwise stated.

You may use the Service for your personal, non-commercial use.

You may not copy, reproduce, distribute, modify, sell, license, publicly display, or create derivative works from NurseLift365 materials without written permission, except as permitted by law.

NurseLift365 may provide motivational quotes, wellness suggestions, educational information, videos, articles, and other content.

We do not guarantee that content will be:

• Complete;
• Accurate;
• Current;
• Appropriate for every individual;
• Suitable for a particular profession or workplace; or
• Applicable to your individual circumstances.

You are responsible for determining whether information is appropriate for you.

Certain features may use artificial intelligence or automated systems.

AI-generated responses may contain errors, omissions, or inaccurate information.

AI features are provided for general informational and motivational purposes and are not a replacement for qualified professional advice.

You should independently verify important information before relying upon it.

Do not submit confidential patient information or other sensitive information to AI features.

NurseLift365 may offer free and paid features.

Free users may receive advertisements.

Premium users may receive additional features, which may include an ad-free experience, additional content, personalization, or other benefits described at the time of purchase.

We reserve the right to modify Premium features, provided that such changes do not unlawfully deprive users of paid benefits already purchased.

Premium subscriptions may be offered on a recurring basis.

Before completing a subscription purchase, you will be shown the applicable price, billing period, and applicable terms.

Unless otherwise stated, subscriptions automatically renew until canceled.

You authorize the applicable payment provider to charge the payment method associated with your subscription.

You may cancel your subscription at any time from Profile → Subscription → Manage subscription in the app, which opens the secure billing portal provided by our payment processor, or by contacting us at support@nurselift365.com.

Cancellation generally prevents future renewal but does not necessarily provide a refund for the current billing period.

Free Trials and Promotional Offers

We may offer free trials and promotional offers, such as a 7-day free trial of Premium. The length of the trial, the price that applies after it, and any eligibility requirements are shown to you before you start.

Where a trial requires a payment method, your paid subscription begins when the trial ends and your payment method is charged the then-current price unless you cancel before the trial ends.

Some offers may require verification, such as a valid school email address, are limited to one per person, and may be modified or withdrawn at any time.

Payments may be processed by third-party payment processors, including Stripe or app-store payment systems.

NurseLift365 does not directly store complete payment card information unless expressly stated.

Payment processors may have their own terms and privacy policies.

We are not responsible for outages, errors, or failures caused by third-party payment processors.

Refund eligibility may depend on the payment platform through which you purchased your subscription.

Where required by law, applicable refund rights will apply.

If your purchase was processed through an app store, you may need to request a refund directly through that platform.

If you purchased Premium through our website and believe you were charged in error or would like to request a refund, contact us at support@nurselift365.com within 30 days of the charge. We review refund requests individually, and an approved refund is returned to the original payment method.

Free versions of NurseLift365 may display advertisements.

Advertisements may be provided by third-party advertising partners.

NurseLift365 does not necessarily endorse products or services displayed in advertisements.

We are not responsible for the accuracy, quality, availability, or performance of third-party products or services advertised through the Service.

The Service may contain links to or integrations with third-party websites, applications, payment processors, advertising networks, analytics providers, or other services.

Third-party services are governed by their own terms and privacy policies.

NurseLift365 is not responsible for the content, security, availability, or practices of third-party services.

If you enable push notifications, NurseLift365 may send motivational messages, reminders, account-related communications, Premium information, or other notifications.

You may disable push notifications through your device settings or applicable application controls.

Disabling notifications may prevent certain features from functioning as intended.

By creating an account, you may receive transactional and service-related emails.

Where legally permitted, we may also send promotional or marketing communications.

You may unsubscribe from marketing communications using the unsubscribe mechanism provided in the communication.

You may continue to receive essential transactional or account-related communications after opting out of marketing communications.

Your use of the Service is also governed by the NurseLift365 Privacy Policy.

The Privacy Policy explains how we collect, use, disclose, and protect personal information.

We use reasonable administrative, technical, and organizational measures designed to protect information.

However, no internet transmission or electronic storage system is completely secure.

We cannot guarantee absolute security.

We may modify, suspend, discontinue, or restrict portions of the Service at any time.

The Service may occasionally be unavailable because of:

• Maintenance;
• Updates;
• Technical problems;
• Internet outages;
• Third-party service interruptions;
• Security incidents; or
• Circumstances beyond our reasonable control.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

NURSELIFT365 DISCLAIMS WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR COMPLETELY ACCURATE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BALANCED WELLNESS LLC, NURSELIFT365, AND THEIR OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM YOUR USE OF THE SERVICE WILL NOT EXCEED THE GREATER OF:

1. THE AMOUNT YOU PAID TO NURSELIFT365 DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
2. $100.

Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Balanced Wellness LLC, NurseLift365, and its owners, officers, employees, contractors, affiliates, and service providers from claims, liabilities, damages, losses, and expenses arising from:

• Your use of the Service;
• Your violation of these Terms;
• Your User Content;
• Your violation of another person’s rights; or
• Your violation of applicable law.

You may stop using NurseLift365 at any time.

We may suspend or terminate your account if we reasonably believe you have violated these Terms, engaged in fraudulent activity, created security risks, or otherwise misused the Service.

Termination does not eliminate obligations that by their nature should survive termination.

We may update these Terms periodically.

When material changes are made, we may provide notice through the Service, email, or another reasonable method.

Your continued use of NurseLift365 after the effective date of updated Terms constitutes acceptance of the revised Terms, to the extent permitted by law.

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Before filing a formal legal claim, you agree to contact NurseLift365 and attempt in good faith to resolve the dispute informally.

Nothing in this section prevents either party from seeking emergency injunctive or equitable relief where legally available.

Any dispute-resolution provisions will be applied only to the extent permitted by applicable law.

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect.

These Terms, together with the Privacy Policy and any additional terms presented for specific features or purchases, constitute the agreement between you and NurseLift365 regarding your use of the Service.

If NurseLift365 is distributed through an app marketplace, additional terms imposed by the applicable marketplace may apply.

Where applicable, the applicable marketplace is a third-party beneficiary of these Terms solely with respect to provisions relating to use of the application through that marketplace.

By creating an account or using NurseLift365, you acknowledge that you have read and agree to these Terms of Service and Privacy Policy.
